287(g) Program

Overview

The 287(g) program, a program that allows deputies to identify and place detainers on illegal criminal aliens for U. S. Immigration and Customs Enforcement (ICE), officially began November 16, 2009.

The Gwinnett County Sheriff’s Department made official application for the 287(g) program on March 3, 2008 and our application was approved by the Department of Homeland Security and ICE on July 10, 2009. The Memorandum of Agreement was signed in October and 18 deputies left in mid October for four weeks of training.

The deputies assigned to the program identify illegal criminal aliens under the supervision of an ICE agent and place detainers on them for ICE. Those inmates are then turned over to ICE for deportation proceedings once their local charges are adjudicated.

The Gwinnett County Sheriff’s Department does not deport anyone. The only time a person’s immigration status is checked in Gwinnett is if they are arrested and brought to jail. At that point, their status is checked and if they are in the country illegally, a detainer is placed for ICE.

Victim Notification

HSI administers the Victim Notifications Program which allows eligible victims and witnesses to obtain reliable and timely information regarding a criminal alien’s release from custody. Victims and witnesses are required to register with HSI in order to receive notification of a criminal alien’s release.

287 (g) Steering Committee




The Gwinnett County Sheriff’s Office will host a 287(g) Steering Committee Meeting on Monday, December 16, 2019, from 10:00 a.m. to 11:00 a.m. The meeting will be held at the Gwinnett County Sheriff’s Office, Classroom B, located at 2900 University Parkway, Lawrenceville, GA 30043. The public is invited to attend the meeting, which will focus solely on the Gwinnett County 287(g) program. If a member of the public wishes to speak or ask questions, he/she must email a request and their specific questions to GCSOinfo287g@gwinnettcounty.com in advance and no later than Friday, December 6, 2019. Names, organizations, if any, must be provided in the email. An agenda for the meeting will be set no later than Friday, December 6, 2019.
